These Terms & Conditions govern your use of AussieLollies.com and any purchase made from Aussie Lollies, operated by Square Deals Pty Limited (“Aussie Lollies”, “Square Deals”, “we”, “us” or “our”).
By accessing this website, placing an order or purchasing any product from us, you agree to be bound by these Terms & Conditions.
1. About Aussie Lollies
Aussie Lollies is an independent online retailer and reseller of packaged food, confectionery, snacks, chocolate, beverages and related consumer products.
Unless expressly stated otherwise, we are not the manufacturer, producer, brand owner, importer, licensor, distributor or authorised representative of the third-party brands sold through this website.
Brand names, trademarks, packaging, logos and product names belong to their respective owners. The sale of a branded product through Aussie Lollies does not imply sponsorship, endorsement, authorisation or affiliation with the manufacturer or brand owner.
2. Our Role as a Retailer
Our role is primarily to source, sell and arrange delivery of third-party products to customers. We do not manufacture the products we sell and generally have no control over their formulation, ingredients, manufacturing processes, production facilities, packaging design or manufacturer quality-control procedures.
Manufacturer representations, statements, nutritional information, ingredient information, allergen declarations, product claims and usage directions remain the responsibility of the manufacturer or other entity that produced or labelled the product, subject always to any rights you have against us under applicable consumer law.
3. Product Information
We make reasonable efforts to provide accurate product descriptions, images, ingredients, allergen information, nutritional information, weights, sizes and other product details.
However, manufacturers frequently change packaging, recipes, ingredients, nutritional information, product sizes and other specifications without prior notice to retailers.
Accordingly, website information should be treated as a general guide only. The product packaging received by you is the most current source of information.
If an ingredient, allergen, dietary requirement, medical condition or other characteristic is important to you, you must check the actual product packaging before consuming or using the product.
4. Allergies, Dietary Requirements and Medical Conditions
You are solely responsible for determining whether a product is suitable for your own dietary, medical, religious or allergy requirements.
Products may contain, or may have been manufactured, handled or packed in facilities that process, allergens including but not limited to nuts, peanuts, milk, soy, wheat, gluten, eggs, sesame and other allergens.
We do not provide medical, nutritional or dietary advice. Information appearing on this website must not be relied upon as a substitute for professional medical or dietary advice.
If you have a serious allergy, intolerance or medical condition, you should consult an appropriate health professional and examine the manufacturer’s packaging before consumption.
5. Consumption and Use of Products
Once a product has been supplied to you, you are responsible for deciding whether, how and when to consume or use it.
You must follow any storage instructions, preparation instructions, age restrictions, warnings, manufacturer directions and expiry or best-before information appearing on the packaging.
To the maximum extent permitted by law, we are not liable for loss, illness, injury, damage or other consequences arising from:
- consuming or using a product contrary to its packaging or intended use;
- ignoring ingredient, allergen or warning information;
- consuming a product despite a known allergy, intolerance or medical condition;
- improper storage after delivery;
- use after the applicable expiry or best-before period;
- misuse, alteration, contamination or tampering after delivery; or
- any other use of a product outside its ordinary and intended purpose.
6. Product Images and Packaging
Product images are illustrative and may differ from the product actually supplied. Packaging, promotional artwork, labels, colours, product shapes, sizes and branding may change.
Where a manufacturer introduces new packaging or a slightly revised product format, we may supply the current available version of that product without separately notifying the customer, provided the product remains materially the product ordered.
7. Pricing
All prices are displayed in the currency shown on the website at the time of purchase. Prices may change at any time without notice.
We reserve the right to correct pricing, typographical, technical or listing errors.
If a product has been listed at an obviously incorrect price due to a technical, administrative or data-entry error, we may cancel the affected order and refund any amount paid.
8. Availability
All products are subject to availability.
We may cancel, substitute or refund unavailable products where necessary. Where reasonably practicable, we may contact you before making a material substitution.
We do not guarantee continued availability of any particular product, flavour, size, brand or packaging format.
9. Orders
Submitting an order does not necessarily mean that we have accepted it. We may reject or cancel an order before dispatch for reasons including:
- stock unavailability;
- suspected fraud;
- incorrect pricing;
- payment failure;
- delivery restrictions;
- suspected commercial misuse;
- incorrect customer information; or
- circumstances beyond our reasonable control.
If we cancel a paid order before dispatch, we will refund the relevant amount paid for the cancelled goods.
10. Shipping and Delivery
We will make reasonable efforts to pack and dispatch orders appropriately and within the estimated timeframes shown on the website.
Delivery dates and transit times are estimates only unless expressly stated otherwise.
We are not responsible for delays caused by postal services, couriers, customs authorities, border inspections, weather events, industrial action, transport disruption, natural disasters, public holidays, incorrect addresses, security screening or other events outside our reasonable control.
11. Risk During Transit
Confectionery and food products may experience movement, cosmetic damage or temperature-related changes during transportation.
By ordering products for delivery, particularly over long distances or internationally, you acknowledge that some degree of transit risk is inherent in shipping food products.
Examples can include:
- minor crushing or denting of outer packaging;
- broken biscuits or confectionery pieces;
- scuffed, creased or marked packaging;
- chocolate becoming soft, bloomed, partially melted or misshapen;
- products settling or moving within their packaging; and
- cosmetic deterioration that does not materially affect the safety of the product.
12. Chocolate and Heat-Sensitive Products
Chocolate and other heat-sensitive products can melt or soften when exposed to warm temperatures. This can occur during domestic or international transport even where products leave us in good condition.
By purchasing heat-sensitive products, you accept the ordinary risk associated with shipping those products through warm climates or during hot weather.
To the maximum extent permitted by law, melting, softening, chocolate bloom, deformation or similar temperature-related cosmetic changes do not automatically entitle a customer to a refund or replacement.
Nothing in this clause excludes rights that cannot lawfully be excluded where the condition of the goods amounts to a failure to comply with an applicable consumer guarantee.
13. Delivery Address
You are responsible for providing a complete and accurate delivery address.
We are not responsible for loss, delay, redirection, additional postage or non-delivery caused by an incorrect, incomplete or outdated address supplied by the customer.
If an order is returned to us because of an incorrect address, non-collection, rejected delivery or similar circumstance, additional shipping charges may apply before the goods can be resent.
14. International Orders
Customers placing international orders are responsible for ensuring that the products they order may lawfully be imported into the destination country.
Customs rules, food-import restrictions, taxes, duties and inspection requirements vary by country and can change without notice.
We do not guarantee that every product is admissible into every country.
The customer is responsible for any customs duties, import taxes, tariffs, brokerage fees, inspection fees or other government charges imposed in the destination country unless expressly stated otherwise.
15. Customs Seizure or Destruction
We are not responsible for delays, seizure, destruction, confiscation or refusal of goods by customs, biosecurity, border, postal or governmental authorities where those events arise from the laws, policies or decisions of the destination country.
Any refund in such circumstances will be considered in accordance with applicable law and the specific circumstances of the order.
16. Returns
Because most products sold by Aussie Lollies are food or consumable goods, we generally do not accept returns for change of mind.
We also generally cannot accept returned food products once they have left our control because we cannot guarantee how they have been stored or handled.
This policy does not affect any rights or remedies that cannot legally be excluded.
17. Change of Mind
We do not provide refunds or exchanges merely because you:
- changed your mind;
- ordered the wrong product;
- do not like the taste;
- expected a different flavour or texture;
- found the same product cheaper elsewhere;
- no longer want the goods; or
- ordered more than you require.
18. Missing, Incorrect or Seriously Damaged Goods
If an item is missing, materially incorrect, substantially damaged or otherwise appears to have a significant problem, please contact us promptly after delivery.
We may require:
- your order number;
- photographs of the item;
- photographs of the packaging;
- the shipping label;
- batch or expiry information; and
- other reasonable information required to investigate the issue.
Depending on the circumstances and your legal rights, an appropriate remedy may include replacement, store credit, partial refund or refund.
19. Minor Packaging Damage
Minor cosmetic packaging damage does not necessarily make a food product defective or unsuitable for consumption.
We will assess complaints regarding packaging damage having regard to the severity of the damage, the nature of the product and whether the product itself remains usable, safe and materially as described.
20. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any guarantee, right, remedy or protection that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
Where the Australian Consumer Law applies, goods come with guarantees including that they are of acceptable quality, reasonably fit for applicable purposes and correspond with their description.
To the extent permitted by law, all other warranties, representations, conditions and liabilities not expressly stated in these Terms are excluded.
21. Manufacturer Responsibility
Where a problem arises primarily from manufacturing, formulation, labelling, packaging or other matters controlled by the manufacturer, we may refer relevant information to the manufacturer or assist you in contacting them.
Nothing in this clause removes any obligation that applicable law places directly on us as the retailer.
22. Manufacturer Recalls
From time to time, manufacturers or authorities may issue product recalls, safety alerts or product withdrawals.
Where we become aware of a recall that materially affects products supplied by us, we may take reasonable steps to notify affected customers where practicable.
Customers should follow the instructions issued by the manufacturer or relevant government authority.
23. Limitation of Liability
To the maximum extent permitted by law, Square Deals Pty Limited, Aussie Lollies and their officers, employees, contractors, affiliates and service providers will not be liable for indirect, incidental, special, exemplary, punitive or consequential loss arising from or connected with:
- use or consumption of products;
- delivery delays;
- loss of opportunity;
- loss of profits or revenue;
- customs actions;
- website outages;
- third-party service failures;
- incorrect use or storage of goods;
- customer allergies, sensitivities or dietary decisions;
- circumstances beyond our reasonable control; or
- reliance on information supplied by a manufacturer or other third party.
This limitation applies only to the extent that such liability can lawfully be excluded or limited.
24. Maximum Liability
Where permitted by law, our aggregate liability arising from a particular order will not exceed the amount actually paid to us for the goods giving rise to the claim.
This limitation does not apply where applicable law prohibits us from limiting liability in that way.
25. Website Information
We do not warrant that this website will always be uninterrupted, error-free, secure or completely accurate.
Website content may contain typographical errors, outdated information or technical inaccuracies. We may correct or update content at any time.
26. Third-Party Services
We use third-party services including payment processors, couriers, postal services, hosting providers, analytics platforms and other technology providers.
We are not responsible for acts, omissions, outages or failures of independent third-party providers except to the extent applicable law makes us responsible.
27. Third-Party Links
Links to other websites are provided for convenience only. We do not control and are not responsible for the content, security, availability, policies or conduct of third-party websites.
28. Intellectual Property
Except for third-party trademarks and materials owned by their respective owners, the content, design, text, graphics, software, branding and other materials forming part of AussieLollies.com are owned by or licensed to Square Deals Pty Limited.
You may not reproduce, distribute, republish, scrape, commercially exploit or otherwise use our website content without permission except as permitted by law.
29. Fraud and Abuse
We may cancel orders, restrict accounts, refuse future service or take other reasonable steps where we reasonably suspect fraud, payment abuse, chargeback abuse, unauthorised transactions, misuse of promotions, resale abuse or other dishonest conduct.
30. Chargebacks
Before initiating a payment chargeback, customers should contact us so that we have a reasonable opportunity to investigate and resolve the issue.
Nothing in this clause limits any lawful right to dispute a transaction through a bank or payment provider.
31. Force Majeure
We are not liable for a delay or failure to perform an obligation caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, flood, war, terrorism, pandemic, government restrictions, strikes, transport disruption, telecommunications failure, supplier failure or major postal or courier disruption.
32. Indemnity
To the extent permitted by law, you agree to indemnify Square Deals Pty Limited against losses, claims or expenses arising from your unlawful misuse of this website, fraudulent conduct, breach of these Terms, or misuse of products contrary to applicable instructions or warnings.
33. Privacy
Your use of this website is also subject to our Privacy Policy.
34. Severability
If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision will be read down or severed to the minimum extent necessary, and the remaining provisions will continue in effect.
35. No Waiver
A failure by us to enforce a provision of these Terms does not constitute a waiver of that provision or any other right.
36. Changes to These Terms
We may amend these Terms & Conditions from time to time. The version published on this website at the time of an order will generally apply to that order, subject to applicable law.
37. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
Subject to any rights you may have under applicable consumer legislation, the parties submit to the jurisdiction of the courts and tribunals of New South Wales and any courts entitled to hear appeals from them.
